Terms of Service ​

1. Acceptance of Terms ​

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you") and Monitrun ("Company," "we," "us," "our"), operated by Mingcui, governing your access to and use of the Monitrun iOS application, website at https://monit.run, and all related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree to these Terms, you must not access or use the Service.

If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Eligibility ​

To use the Service, you must:

  1. Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
  2. Be at least 18 years of age (or the age of legal majority) to make purchases or enter into binding contracts
  3. Not be barred from using the Service under applicable law
  4. Not be located in a country subject to comprehensive economic sanctions

If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Account Registration ​

3.1 Account Creation ​

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account

3.2 Account Methods ​

We support the following registration and login methods:

  • Email address + verification code
  • Email address + password
  • Username + password
  • Phone number + SMS verification code
  • Sign in with Apple (if available)

3.3 Account Security ​

You are responsible for safeguarding your account credentials. Notify us immediately at virskor@gmail.com if you suspect unauthorized access to your account. We are not liable for any loss or damage resulting from your failure to protect your account.

3.4 Account Termination by User ​

You may delete your account at any time through the app (Settings → Account → Delete Account) or by contacting virskor@gmail.com. Upon deletion:

  • Your personal data will be deleted in accordance with our Privacy Policy
  • Your monitoring configurations and historical data will be permanently removed
  • Any active subscriptions will be canceled (see Section 7 for refund policy)

4. Service Description ​

4.1 Core Functionality ​

Monitrun provides website monitoring services, including:

  • Uptime Monitoring: Automated HTTP/HTTPS checks to determine website availability
  • Ping Monitoring: Network latency measurement via TCP connection
  • SSL Certificate Monitoring: Tracking certificate expiration and validity
  • Status Code Reporting: HTTP response code analysis
  • Response Time Measurement: Website load time tracking
  • Custom HTTP Headers: User-defined request headers for monitoring

4.2 Push Notifications ​

The Service provides push notifications to alert you of:

  • Website availability changes
  • SSL certificate expiration warnings
  • Service status updates

Push notifications require an internet connection and are subject to Apple Push Notification service availability. We do not guarantee delivery timing or reliability of push notifications.

4.3 Service Availability ​

We strive to maintain high availability of the Service but do not guarantee uninterrupted, error-free, or secure operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Factors beyond our reasonable control (e.g., internet outages, force majeure events)

5. Acceptable Use ​

5.1 Permitted Use ​

You may use the Service solely for lawful purposes and in accordance with these Terms. You agree to use the Service only for monitoring websites and services that you own, operate, or have explicit permission to monitor.

5.2 Prohibited Activities ​

You agree NOT to:

  • Monitor websites without the owner's consent
  • Use the Service to conduct unauthorized scanning, testing, or attacks against third-party systems
  • Attempt to gain unauthorized access to our systems, servers, or networks
  • Use automated means (bots, scripts) to create accounts or interact with the Service outside the official app
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to transmit malware, spam, or other harmful content
  • Violate any applicable local, state, national, or international law or regulation
  • Impersonate any person or entity or misrepresent your affiliation
  • Resell, sublicense, or commercially exploit the Service without written authorization

5.3 Monitoring Limits ​

To ensure fair usage and service stability, we impose reasonable limits on:

  • Number of monitored websites (varies by subscription tier)
  • Monitoring frequency (varping by subscription tier)
  • API request rates
  • Data retention periods

Excessive usage beyond published limits may result in rate limiting, account review, or suspension.

6. Free and Premium Plans ​

6.1 Free Tier ​

Monitrun offers a free tier with limited features and capacity. We reserve the right to modify the features and limits of the free tier at any time with reasonable notice.

6.2 Premium Subscription ​

Premium features require an active paid subscription purchased through Apple In-App Purchase:

  • Subscriptions are managed through your Apple ID account
  • Payment is charged to your Apple ID upon purchase confirmation
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID account settings

6.3 Price Changes ​

We reserve the right to adjust subscription pricing. Price changes will be communicated at least 30 days in advance. Your continued use of premium features after a price change constitutes acceptance of the new pricing.

7. Refund Policy ​

7.1 Apple In-App Purchase Refunds ​

All subscription payments are processed through Apple. Refund requests must be submitted to Apple through their standard refund process:

We cannot process refunds directly as payment processing is handled by Apple.

7.2 Cancellation ​

Canceling a subscription stops auto-renewal but does not provide a refund for the current billing period. You will retain access to premium features until the end of the paid period.

8. Intellectual Property ​

8.1 Our Intellectual Property ​

The Service, including its original content, features, functionality, design, code, and documentation, is owned by Monitrun and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 License to Use ​

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Monitrun app on iOS devices you own or control
  • Access and use the Service for your personal or internal business purposes

This license does not include the right to:

  • Modify, adapt, or create derivative works of the Service
  • Distribute, sublicense, or transfer the Service to third parties
  • Use the Service for competitive analysis or building a competing product

8.3 User Content ​

You retain ownership of the data you input into the Service (monitored URLs, configurations). By using the Service, you grant us a limited license to process and store this data solely for the purpose of providing the Service.

8.4 Feedback ​

If you provide suggestions, ideas, or feedback, we may use such feedback without obligation or compensation to you.

9. Disclaimer of Warranties ​

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MONIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF MONITORING RESULTS
  • WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

MONITORING RESULTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE BASIS FOR CRITICAL BUSINESS DECISIONS.

10. Limitation of Liability ​

10.1 Exclusion of Damages ​

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONIT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • ANY DAMAGE RESULTING FROM RELIANCE ON MONITORING RESULTS OR NOTIFICATIONS
  • ANY DAMAGE RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • ANY DAMAGE RESULTING FROM SERVICE INTERRUPTIONS OR DOWNTIME

10.2 Aggregate Liability ​

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10.3 Exceptions ​

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Indemnification ​

You agree to indemnify, defend, and hold harmless Monitrun and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Service
  • Your violation of any applicable law or regulation

12. Termination ​

12.1 Termination by You ​

You may terminate your account and these Terms at any time by deleting your account as described in Section 3.4.

12.2 Termination by Us ​

We may suspend or terminate your access to the Service, with or without notice, for:

  • Violation of these Terms
  • Conduct that we reasonably believe is harmful to other users, us, or third parties
  • Extended periods of inactivity
  • Non-payment of fees owed
  • Requests by law enforcement or government agencies
  • Discontinuation of the Service (with 30 days' notice)

12.3 Effect of Termination ​

Upon termination:

  • Your right to use the Service ceases immediately
  • We will delete your data in accordance with our Privacy Policy
  • Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), and 13 (General Provisions) survive termination

13. General Provisions ​

13.1 Governing Law ​

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of Monitrun's principal place of business, without regard to conflict of law principles.

For users in the European Union, European Economic Area, or United Kingdom: These Terms are governed by the applicable law of your country of residence, and you retain any mandatory consumer protection rights under local law.

13.2 Dispute Resolution ​

Informal Resolution: Before initiating formal proceedings, you agree to first contact us at virskor@gmail.com to attempt to resolve the dispute informally for at least 30 days.

Arbitration (US Users): Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, except as modified by this Agreement.

Small Claims: Either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

Class Action Waiver: TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13.3 Severability ​

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

13.4 Entire Agreement ​

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Monitrun concerning the Service and supersede all prior agreements, understandings, and representations.

13.5 Amendments ​

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

  • In-app notification at least 14 days before taking effect
  • Email notification to your registered email address
  • Posting the updated Terms on our website with a revised "Last Updated" date

Continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.

13.6 Waiver ​

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.7 Assignment ​

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

13.8 Force Majeure ​

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, or internet infrastructure failures.

14. Apple-Specific Terms ​

14.1 Acknowledgment ​

You acknowledge that these Terms are between you and Monitrun only, not with Apple Inc. ("Apple"). Monitrun, not Apple, is solely responsible for the Monitrun app and its content.

14.2 Scope of License ​

The license granted to you for the Monitrun app is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.

14.3 Maintenance and Support ​

Monitrun is solely responsible for providing any maintenance and support services for the app. Apple has no obligation to furnish any maintenance or support services.

14.4 Warranty ​

Monitrun is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. Apple will have no other warranty obligation with respect to the app.

14.5 Product Claims ​

Monitrun, not Apple, is responsible for addressing any claims relating to the app or your possession/use of the app, including but not limited to:

  • Product liability claims
  • Any claim that the app fails to conform to any applicable legal or regulatory requirement
  • Claims arising under consumer protection, privacy, or similar legislation

14.6 Third-Party Intellectual Property Claims ​

Monitrun shall not be obligated to indemnify or defend you with respect to any third-party claim that the app or your possession/use of the app infringes any third-party intellectual property right.

14.7 Legal Relationship ​

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

14.8 Third-Party Beneficiary ​

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

These Terms of Service are available in English only. In case of any discrepancy between translations, the English version shall prevail.
